Athens County is a dynamic center for art, entertainment, tourism, shopping, and recreation. Athens County is located in the southeastern portion of the state, and is part of Ohio's Appalachian Region. U.S. Route 50 and State Routes 32, 56 and 550 cross the county east and west, and U.S. Route 33 and State Routes 13, 144, 529 and 681 run north and south. The Hocking River flows into the Ohio River in Athens County.
Athens County and the City of Athens were established with the idea of having a university west of the Alleghenies. Ohio University in Athens City became the first college founded in the Northwest Territory. The University has added to the area's blend of country and culture. One of the University's earliest Presidents was William Holmes McGuffey, the author of the McGuffey Reader.
Major attractions in Athens County include the Wayne National Forest, Zaleski State Forest, Burr Oak State Park and Lodge, Stroud's Run State Park, Athens County Historical Society and Museum, Dairy Barn Southeastern Ohio, Cultural Arts Center, Robbins Crossing, Hocking Valley Scenic Railway and Ohio University.

First institution of higher learning in the Northwest Territory. Cutler Hall is the oldest academic building west of the Allegheny Mountains and is a National Historic Landmark. Enrollment today is more than 19,000; Ohio University has five branch campuses. There are 335 undergraduate areas of study. Maintain traffic counts on county roads. If business will need utilities crossing or boring beneath road, owner must come in for a utility permit. Personal Property Tax
When you obtain your vendor’s license, you are given a packet with a 920NT form (new tax paper) to fill out to report personal property or call and request booklet to be mailed to you. · These returns must be filed with the County Auditor within 90 days after your first sale and thereafter on a yearly basis between February 15 and April 30. It is important to file in a timely manner. Personal property items are anything used in business such as inventory, machinery, etc.; all are taxed. Commercial real estate is tangible personal property and is also taxed. If you produce a product, product inventory is reported. Once the business owner purchases their vendor’s license, they will automatically be contacted by the state regarding sales tax.

Certain businesses may require approval and licensing by local health departments, for example, tattoo parlors get approval, campgrounds and trailer parks get licenses. Several municipalities in this area issue and administer this license and it would be wise to contact this county agency to identify any requirement. The County Health Department issues restaurant and food service licensing, and are responsible for inspecting and approving all eating and lodging establishments. If food business, county tests well water annually of private water supply. If new food establishment, must submit for plan review to Health Department. Plan review fee based on risk; usually one-half of license cost and paid only one time. County must review and accept or reject within 30 days. There is an inspection, a waiting period, and a charge for this license, so be sure to apply early. Fee for the food service license varies, depending on type of food prepared (risk) category and also size in sq. footage of restaurant. Level I - $100; Level II - $200; Level III - $300; plus additional $20 fee sent on to the state. Fee is due on March 1st each year. Classes and fees change March 2001 to five (5) levels. There will be five (5) levels of fees, depending on food served and size of facility. The County Health Department issues well and septic permits; reviews trash complaints outside the villages, tracks county vital statistics and maintain a nursing division, which administers various inoculations and implements public health programming. T. B. testing is required for food service operators. Licensing is also required for vending machines, mobile operations ($100) and temporary food service like at a fairgrounds ($50 per event). The County Health Department issues permits for assuring that private water supplies, swimming pools and sewage disposal systems are properly installed and functioning. Investigates any environmental problems, which may pose a hazard to the public health. Athens County has NO plumbing code. Exception: commercial businesses are referred to Muskingum County Building Department (740-455-7905) to submit building plans to them to ensure everything meets state code (plumbing). This is a regional office for the State Department of Commerce, Division of Factory and Buildings.
Business must comply with checklist of state regulations and license requirements. Starting in March 2001, State Department of Agriculture will be transferring licensing and inspection of food establishments, like grocery stores and drug stores, to Athens County Department of Health. If you drill a well for a business, you must submit plan to the Health Department for review and obtain a permit to drill. A licensed and bonded contractor must do well drilling. A test sample is sent to certified lab, i.e., Athens City Water Plant for bacteria testing. Users cannot exceed 15 employees or customers. If employee or customer users are more than 15, a lab testing referral is made to Ohio EPA.

The Ohio Department of Agriculture Division of Food Safety licenses home bakeries, but inspections are scheduled with the regional food inspector. If you wish to sell baked good to the public, you must have your kitchen facilities inspected annually.

Municipal taxes are levied and collected by several different methods in Athens County. Municipal taxes are collected through each municipality’s court system. Contact the City, Village or Township Hall of the legal municipality in which you intend to operate and identify what taxing agency with which you are to deal. Contact the appropriate taxing agency and identify your tax responsibilities. Employers are responsible for withholding tax payments from their employees and remitting this to the appropriate taxing authority when due.
In addition to the tax on individual wages, a municipal income tax also exists on net profits of corporations, partnerships, estates, and trusts. Be sure to recognize this liability and take the required steps to obtain the necessary forms so that you may file within the prescribed time period. In Athens, the city levies a 1.65% income tax (some employers withhold city income tax). In Athens, there is no local sales tax. Business owners may activate an income tax account with the city by phone, mail or in person. The Income Tax office is open from 8:00 a.m. to 5:00 p.m. Monday through Friday. Deadlines for withholding tax payments are due quarterly. Businesses are required to file an annual tax return no later than April 30.

The Mayor’s Office provides referrals to Economic Development Resources and appropriate city offices. Businesses locating outside city may inquire regarding annexation. Mayor also reviews business requests for tax abatement. Mayor also serves on Planning Commission Board.

The Planning Commission reviews new subdivision requests. Anything that does not conform to code regulations or request for variances goes to the Planning Commission and then to City Council for final approval. Some code cases go on to the Zoning Board for review. The Planning Commission meets the first and third Thursday of the month at 2:30 p.m. on the 3rd floor of the City building.

The City of Athens has a zoning code in effect. New business owners are advised to consult with the following officials in the Code Enforcement Office before buying and/or building any structure. Sites within city limits require building permits. Building permit fee for remodeling is $30.00 of first $1,000 of construction; additional $1.50 per $1,000 of construction after that. Plumbing permit fee is $20.00 plus $2.50 per trap. New building permit fee is $50.00 plus 3¢ per square foot. On commercial construction there is no local building inspection. Business owners are referred to Jeff Lesko, Plans Examiner for Athens County (740-592-6312). Home-based businesses give their address, if in residential area, some meet “occupant permitted” regulations and some do not. If declined, business owner may appeal.

If business location requires new installation of sewer and water, there is a tap fee (impact fee), which varies, depending on size and type of building. Minimum fee for each is $1,000.00.
